Terms of Service – Preloved Padel

Welcome to Preloved Padel, South Africa’s first dedicated online marketplace for buying and selling pre-owned padel equipment. By using our platform, you agree to the following Terms of Service (“Terms”). Please read them carefully.

1. Definitions

  • “Platform” means the Preloved Padel website and services.

  • “Seller” means any person or entity listing an item for sale.

  • “Buyer” means any person or entity purchasing an item through the platform.

  • “Item” means any product listed for sale on the platform.

2. Marketplace Role

Preloved Padel provides a secure platform to connect buyers and sellers. We are not the manufacturer, owner, or direct seller of items, but we facilitate transactions, payment, and dispute resolution.

3. Fees and Commission

To ensure transparency, our commission structure is fixed as follows:

  • Listing & Advertising Fee: 9% of the final sale price

  • Management & Platform Fee: 9% of the final sale price

  • Total Commission: 18% of the final sale price

These fees are automatically deducted from the seller’s payout once a sale is successfully completed.

4. Payment and Payouts

  • Buyers make payment through the platform.

  • Payment is held securely until the buyer confirms receipt and satisfaction.

  • If no confirmation is received within 48 hours of delivery, the transaction will be deemed completed and funds will be released to the seller.

  • Seller payouts are made within 3–5 business days of completion.

  • In cases of disputes, Preloved Padel’s decision is final and binding unless otherwise required by South African law.

5. Refunds and Returns

  • Buyers must inspect items immediately upon delivery.

  • Any issue (misrepresentation, incorrect item, undisclosed defect) must be reported to Preloved Padel within 48 hours of delivery.

  • If a claim is valid, Preloved Padel may process a refund to the buyer and withhold seller payout until resolution.

  • If no claim is made within the timeframe, the transaction is considered final.

6. Seller Obligations

By listing an item, the seller warrants that:

  • They are the legal owner of the item and have the right to sell it.

  • The item description and photos are accurate and truthful.

  • The item is free from undisclosed damage or defects.

  • The item is not counterfeit, stolen, or prohibited under South African law.

7. Buyer Obligations

By purchasing an item, the buyer agrees to:

  • Inspect the item upon delivery.

  • Report any issues within 48 hours.

  • Understand that all sales are final after the inspection window, except as required by law.

8. Shipping

  • Preloved Padel uses trusted courier partners via BobGo.

  • Shipping costs are calculated at checkout.

  • Responsibility for the item passes to the buyer upon confirmed delivery.

  • In case of loss or damage in transit, claims will be handled according to the courier’s policies.

9. Disputes

  • Preloved Padel will mediate disputes between buyers and sellers in good faith.

  • Our decision will be final in resolving platform-related disputes, unless South African law requires otherwise.

  • Legal claims beyond our resolution process must be pursued independently.

10. Limitation of Liability

Preloved Padel is not liable for:

  • The quality, authenticity, or condition of items listed by sellers.

  • Losses, damages, or delays caused by third-party couriers.

  • Indirect, incidental, or consequential damages.

Our liability is limited to the total commission earned on the disputed transaction.

11. Indemnification

Sellers and buyers agree to indemnify and hold harmless Preloved Padel, its employees, and partners from any claims, damages, or legal costs arising from their use of the platform.

12. Amendments

We may update these Terms from time to time. Sellers and buyers will be notified of changes via the website. Continued use of the platform constitutes acceptance of updated Terms.

13. Governing Law

These Terms are governed by the laws of South Africa. Any legal proceedings must be brought in South African courts.

14. Marketing & Communication

By providing your contact details (including phone number or email), you consent to receive marketing communications from Preloved Padel, including order updates, promotions, and special offers. You may opt out at any time by following the instructions provided in each message (e.g., replying “STOP” to SMS or clicking “unsubscribe” in emails). For more information, see our Privacy Policy.
